resulting from owning and running EPA and state certified industrial
analytical laboratories over the period 1967 to 1985 serving every major
industry type except biochemical and nuclear.
My work

Breath Testing and Expert Testimony My
expertise has been used primarily for industrial clients and applications.
I have been involved in forensic applications including consulting and
investigation in the areas of product liability, DUI, drug testing, arson
and other criminal actions. I have been engaged for sponsored
product research and development for commercially important products in
drug testing, DUI testing and chemical manufacture which have resulted in
a number of patents.
I
have been asked to testify in cases requiring our technical expertise.
I have been judged to be a qualified expert witness in Federal
District Courts and State courts in Pennsylvania, Delaware, Virginia,
North Carolina, South Carolina and Georgia.
My
involvement in forensic testimony covers a wide range of topics all
involved with analytical chemical procedures, tests, the
interpretation of data, and limitations inherent in test protocols
used for data gathering, quality control, instrument validation, and
evaluation of the test result reported for precision and accuracy.
The basis for my testimony in DUI testing results especially as it
relates to data collected and used in DUI trials is as follows:
- Academic training (BS (1955) and MS (1966) in Science from
Clemson and the University of Tennessee at Knoxville,
- Industrial training and supplemental course work in Infrared
Spectroscopy at Brooklyn Polytechnic Institute,
- Attendance and completion of the Beginning and Instructor
courses at National Patent Analytical Systems in Mansfield, Ohio,
- Attendance and completion of the certified NTSA training course
in DUI Detection in Atlanta
- Ownership of 2 Datamaster Breathanalyzers and Intoxilyzer 3000
- Lecturer at Sponsored DUI Courses and Seminars at Harvard and
Myrtle Beach
- Own a Model 2000 PE FTIR research Infrared Spectrophotometer
with computer interface and Spectral Libraries
- Own and maintain a completely equipped analytical laboratory
capable of performing tests required for arson investigation,
chemical spills, complex mixture (pills, etc) analysis, and trace
contaminate identification including but not limited to vapor
analysis, particle analysis, complex liquid identification, etc.
- Maintain contacts with certified laboratories, the University of
SC and Clemson University for more exotic technologies and
testing.
- Experiments performed in my laboratory, or test sites under my
supervision, using test subjects and known samples under rigidly
controlled conditions for breath testing, breath volume, blood
sampling and analysis.
- Experimental validation of BA of subjects as a function of time
and alcohol intake
- Experimental validation of instrument makers claims for
equipment.
- Determine the band pass of the filters used in the DUI test
equipment and compared the spectra of various gases at the band
pass measured to demonstrate interference potential for them.
- Expert testimony in spirometry results evaluation (not medical
testimony)
